Terms of Service

These conditions are governed by and interpreted in accordance with the laws of England and Wales. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If you are a consumer residing in Scotland or Northern Ireland, you also benefit from any mandatory consumer protection provisions and may bring claims in the courts of your local jurisdiction. Both Plodium and you agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.

By accessing the Plodium network, you agree to comply with our infrastructure standards. Plodium reserves the right to amend or modify these Terms of Service at any time, when significant amendments are made, we will notify registered users via their registered email address, the Plodium Billing Portal, our control panel, or any official third-party applications we use to notify everyone (e.g. Discord). These terms constitute a legally binding agreement between you and Plodium concerning your access to and use of Plodium services. By accessing our services, you agree to be bound by these Terms. If you do not agree to any current or amended Terms, you must cease using our services immediately. Users under fourteen (14) must have a parent or guardian review and agree to these Terms.

Plodium is an independent service provider and is not affiliated with, endorsed by, or sponsored by any third-party companies whose platform or software may be used in conjunction with our services. This includes, but is not limited to, Mojang AB, Microsoft Corporation, Facepunch Studios, Hypixel Inc., and Valve Corporation. All trademarks, service marks, and company names are the property of their respective owners. Use of such names does not imply any partnership, endorsement, or approval!

For proper interpretation of these Terms and any associated Service Level Agreement (SLA), the following definitions apply, unless the context otherwise requires:

1. User: Any individual or entity maintaining an active subscription to Plodium’s services.

2. Base Monthly Service Fee: The core recurring fee paid for the standard subscription level. This specifically excludes one-time setup fees, taxes, or charges for optional add-ons, such as additional storage, dedicated IP addresses, or premium support features.

To register for an account at Plodium, you must be at least fourteen (14) years old. Users below this age must have a parent or legal guardian create and manage the account on their behalf. Parents or legal guardians are fully responsible for the child's activity on our services in accordance with UK online safety standards.

Our service allows you to upload, store, and manage data, including game files, modifications, and configurations. You retain responsibility for all content hosted on your assigned server, ensuring its legality and appropriateness under UK law (including the Malicious Communications Act and the Online Safety Act). Plodium does not monitor user content but reserves the right to remove material that violates these Terms or legal standards.

Plodium provides high-performance infrastructure solutions, including but is not limited to: game server hosting, application hosting, virtual machines, bare-metal servers, advanced DDoS mitigation, technical support, and access to a control panel for managing your services. We reserve the right to modify, enhance, or deprecate specific features of the service to maintain network integrity and performance standards.

Plodium offers a range of hosting services, including but is not limited to:

1. Game Server Hosting (Minecraft, Hytale, Rust, etc.): High performance servers optimal for gamers that do not want to deal with the hassle of hosting it themselves.

2. Code Hosting: For developers who want to host their applications, APIs, or Discord Bots on our infrastructure.

4. Virtual Private Servers (VPS): For users who want to have more control over their hosting environment, with root access and the ability to install custom software.

5. Virtual Dedicated Servers (VDS): For users who require dedicated resources and enhanced performance for their applications or game servers.

6. Dedicated Servers/Bare Metal: For users who need the highest level of performance and control, with dedicated hardware resources and full administrative access.

You must provide your true legal name and accurate contact information when creating an account! The use of pseudonyms or false identities is strictly prohibited. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or suspected breach of security. Plodium will not be liable for any loss or damage arising from your failure to comply with this obligation. Creating alternate or duplicate accounts is prohibited and may result in the immediate termination of all associated services.

You may cancel your subscription at any time through our billing portal or by contacting support. When cancelling, you may choose to have the cancellation take effect immediately or at the end of your current paid billing period. If you choose immediate cancellation, access to your services will be terminated instantly.

You may not use our services for unlawful or unauthorized purposes. Prohibited activities include, but are not limited to, port scanning, collecting user information for spam, defrauding or misleading users, misusing support services, impersonating entities, uploading malicious software, cryptocurrency mining or operating blockchain-related services, performing or facilitating DDoS attacks, hosting or distributing copyrighted material without authorization, hosting or distributing pornographic, obscene, or otherwise inappropriate content, content that promotes violence, hatred, or terrorism, operating gambling or betting services, running VPNs or other anonymity networks unless explicitly permitted, data scraping or automated data collection, or abusing server resources. If you are caught engaging in these prohibited activities, your services will be subject to immediate termination without notice and you will not be eligible for a refund. Violations may also be reported to the relevant UK or international authorities.

The materials appearing on Plodium's websites could include technical, typographical, or photographic errors. Plodium does not warrant that any of the materials on its websites are accurate, complete, or current. While we aim to keep our information updated and will endeavour to correct errors as they are identified, Plodium may make changes to the materials contained on its websites at any time without notice.

We accept payments exclusively through Stripe, supporting major cards and PayPal where available. You agree to provide accurate billing information and authorize charges. For new Game Server Hosting and Application services, an invoice is created at checkout and must be paid within 7 days, or the order will be automatically cancelled. For active Game Server Hosting and Application services, users are notified 7 days prior to the invoice due date. If the invoice remains unpaid after the due date, the server will be suspended for 7 days and deleted if not paid within that period. For VPS and VDS services, the same process applies, but data will be retained for 14 days before deletion. For Dedicated Server services, payment must be received within 14 days of the invoice due date, after which the service data will be permanently deleted, no suspension period applies.

Refunds are available within seventy-two (72) hours from the time of purchase and are limited strictly to the base monthly service fee. This does not affect your statutory rights under the Consumer Rights Act 2015. Refunds apply only to payments processed through Stripe. Dedicated Server services are non-refundable once provisioned due to the allocation of physical hardware resources. If a chargeback or dispute is initiated, Plodium reserves the right to immediately suspend or terminate all associated services and accounts. In the event of a dispute, all associated services and the user account may be permanently terminated from Plodium systems without further notice.

Accounts may be suspended or terminated at any time, with or without prior notice, for violations of these Terms, including but is not limited to non-payment, abuse, or illegal activities. Termination of services may result in the deletion of all associated data in accordance with the applicable service-specific data retention and deletion timeframes outlined in these Terms. You may request account termination at any time through our support ticket (via our Billing Portal).

To report abuse, contact abuse@plodium.com. Complaints will be forwarded to the associated user and must be resolved promptly. Services may be suspended during investigations.
